About a week ago I saw a piece at the NYT that argued that Democrats would be better off if Roe v Wade was repealed and sent back to the states on the grounds that it would take the issue off the table and allow religious people who might like Democrat social programs but for some reason draw a line in the sand over murdering kids, a reason to return to the party.

I found the argument interesting in the sense that the reason why I left the Democrat Party in the 90’s was I concluded that as a practicing Catholic I just plan wasn’t welcome anymore.

That issue, becoming the sacred cow for the party combined with the move of the Democrats to a secular party makes a tough generational fight against a party that welcomes those who choose to “be fruitful and multiply” but amazingly the Democrats are on the verge of repeating this mistake with a totally different set of voters on a totally different issue. Court Packing.

Joe Biden and Kamala Harris have already balked on giving their position on the issue (I helpfully outlined it for them earlier this week) and it seems they are not the only candidates ducking and weaving with the subject comes around.

Other Democrats, in safe seats in deep blue states have been less circumspect:

Senator Ed Markey of Massachusetts recently urged Democrats to support court-packing if Republican Senate Majority Leader Mitch McConnell moves to confirm President Donald Trump’s Supreme Court nominee Amy Coney Barrett.

“Mitch McConnell set the precedent,” Markey tweeted. “No Supreme Court vacancies filled in an election year. If he violates it, when Democrats control the Senate in the next Congress, we must abolish the filibuster and expand the Supreme Court.”

Congressman Joe Kennedy of Massachusetts issued a similar statement in support of court packing. “If [McConnell] holds a vote in 2020, we pack the court in 2021. It’s that simple,” he tweeted on September 19. Grassroots progressive groups like the Justice Democrats have also supported the idea.

Democratic Congresswoman Alexandria Ocasio-Cortez on Saturday told NBC, “We should leave all options on the table, including the number of justices that are on the Supreme Court.” Her remarks have also been echoed by Democratic Senate Minority Leader Chuck Schumer of New York.

Their public embrace of this position completely changes the game and cements the trap.

This means that in every house race and in every senate race this year the whole “packing the court” issue can be raised over and over again and Democrats will have the fun choice of bucking their angry Marxist base or keeping their mouth shut

I’m suggested that Trump can checkmate the Democrats by introducing a Constitutional Amendment to fix the Supreme Court at nine seats. While it will come in handy this time around it has The democrats rejection of such an amendment can cement the issue for those worried about the destruction of the court system for decades.

It will be abortion all over with a whole different set of voters.

If Conservatives are smart they will force the Democrats into this dilemma and if they play it right, they’ll have an issue that will make coin GOP majorities long after Donald Trump is out of office.

If Democrats are smart they’ll help that constitutional amendment I suggested pass congress and while feigning opposition guide it though ratification to take the issue off the table as soon as possible, because if they don’t this trap will close on the and hold their party tight.

As the Civil War began the most prominent general on the Confederate side was Albert Sydney Johnston formally of the 2nd US Calvary. Johnston was put in command of Confederate forces in the western theater which meant from the Mississippi river to the Appalachian mountains. His primary job was to stem any Union advance into Tennessee while keeping the Mississippi open to allow men & supplies from the far west (the Transmississippi) to continue to flow to the east.

Johnston was an able general with a well earned reputation as an excellent fighting officer, but realized rather quickly that he neither had the men or the supplies necessary to hold this line against the Union forces that were being arrayed against him. His concluded his best chance on stopping any Union advance was via bluff, namely making said union forces believe that HE was planning a major advance with an army much larger than he actually had.

So all over the press stories were planted doubling and tripling the size of his forces while reporting that he was preparing to advance on a half dozen different cities along a nearly 1000 mile front. At the same time as this was being reported Johnson was sending private requests to Jefferson Davis for reinforcement and resupply.

For a time this was wildly successful. defenses were prepared to stop the expected rebel advances. Governors balked at sending troops to the Army of the Potomac when they would be needed to fend off Johnson’s supposed hoards. In fact it was so successful that it fooled some confederate leaders. When PGT Beauregard was transferred west to serve under Johnson he was shocked to discover the actual strength of the force he was joining.

Eventually the Union forces did advance. US Grant took forts Henry and Donaldson and Union forces poured into Tennessee and Johnston would retreat into Mississippi. Johnston would eventually attack at Shiloh hoping to destroy the divided Union forces and be killed during the 1st day of the battle on April 6th 1862.

I tell this story because as I see stories like this.

It occurs to me that these modern Democrats who previously were using the same language as slavery supporting confederates from 1860 are using the same election battle plan as their Civil War Counterparts as well.

Having failed to remove the president via the Mueller investigation and Impeachment and having the Corona and Riot Brier Patches bite primarily on Democrat cities and office holders the primary tool of the Democrat left seems to be going all in on a media propaganda effort that the polling (done by absolutely TOP people from absolutely TOP organizations with absolutely TOP standards) indicates that the Trump campaign is on the road for a defeat of biblical proportions.

The purpose of this is to keep the faithful in the bubble fighting and to keep the morale up of an industry that has shrunk it’s customer base to the point where those who remain can’t abide any statement contrary to the narrative that they have been advancing.

Unfortunately for the media they have one disadvantage that General Johnston did not. There is an actual drop dead date for this tactic, namely election day, although in fairness the attempt to push the idea that mail in ballots will be enough to change a Trump election night victory to a defeat will likely continue until it’s clear that there simply aren’t enough votes to steal in enough states to reverse the result.

Perhaps we will see the “faithless electors” card played again and perhaps the left will run to the courts but in the end the clock will run out on the tactic of bluff and bluster and the media and their allies will have to deal with the reality of a defeat.

I suspect that there are more than a few who have already guessed what’s coming but for those who have not it will be quite a shock that I suspect will be featured in youtube videos for years to come.

With the formal nomination of Amy Coney Barrett and the knowledge that Mitch McConnell and Donald Trump already have the votes to put her on the Supreme Court the Democrats find themselves in one of the worst dilemmas that they need to face.

In a more pragmatic age the Democrats would make a few pro-forma statements ask a few pointed questions and make some fuss in the press and that would be it.

But this is not a normal age, this is an age of lunacy, an age of violent militant leftists and Bernie Bros who might not turn out for candidates who are not suffivently woke and angry.

Even worse for the left these folks are not above violence against their own side as Ted Wheeler can tell you.

If it was up to them the hearings would be the Charge of the Light Brigade with every gun firing and every voice shouting.

This of course is political suicide in an election where you need swing states and most importantly in an election where you have Democrats in the house and candidates for the senate who can’t appear as lunatics right before the voters vote.

So the Democrats need a feint, not so much to spook or fool the “Party of StupidTM (although if the make a mistake dumb enough to derail the nomination they’ll jump at it) but to fool the radical millitant left into thinking they’re ready to charge into the valley of death to stop her.

If it was up to me I’d go with the boycotting of the hearings and having some sort of large rally outside the SCOTUS. That way they can scream and shout and allow their minions to weep and gnash their teeth to their hearts content and throw in some “performance art” without actually doing anything on the record that might cost them votes they will need come election day. The angry/loony left which is their biggest danger tends to be moved by that kind of stuff.

If they are really desperate they can extend this to the actual vote where once the GOP has their 50th vote they can walk out enmasse, again plenty of symbolism without the stupidity.

Either way it’s their problem and I look forward to watching them crash and burn whatever they do
