What a Judge does

Ann Althouse cuts to the chase on how being a judge is supposed to work:

Scalia is resisting telling us about his personal views because they are irrelevant to the work of a judge, and he’s modeling upstanding judicial behavior, saying what the law is and nothing more.

The second quote is even better than the first:

You may think it’s cruel of Scalia to deprive us of soothing words, but don’t be tricked about why he writes like that. Scalia is adhering to the most basic legal proposition that judges must decide cases according to the law and leave the rest to the processes of democracy

In a democracy it is the people representatives who are supposed to make the law. Ann gets it. I think a debate on the subject between her and Darren Hutchinson would fill a hall and expand the mind.

There are 150,000 people joining the Catholic Church this week in the US. We’ve already mentioned Newt Gingrich, but the Curt Jester points to another one that is worth noticing:

The Scharbachs, practicing Anglicans for the last several years, believe they have found that sense of belonging in the Archdiocese of Baltimore and the Roman Catholic Church, which the family hopes to join during Easter Vigil at next-door Holy Cross parish.

“We’ve always thought that this is the only church that has remained steadfast on moral issues and has a worldwide witness to that,” Mrs. Scharbach said. “It’s a worldwide voice saying, ‘This is wrong.’ ”

Asked why this is the time for him and his family to convert, Mr. Scharbach offered a simple answer: “The magisterium – to be in communion with the Holy See.”

Just months ago, Mr. Scharbach was a promising Anglican priest at the Church of the Good Shepherd, Rosemont, near Philadelphia.

His bottom line is however the most significant:

“I realized I can live without being Roman Catholic, but I couldn’t die without being Roman Catholic,” Mr. Scharbach said.

That’s what it all comes down to. And if the Anchoress is right we will need people of strength for what is coming:

Just be ready, is all I am saying. And practice prayer – which is the most subversive of liberties; it can never be taken from you, and is a source of power and strength. Train yourself in prayer. Begin now, so that you are a fit, skilled practitioner when the need arises.

You never know the day or hour.

I think that excerpt demonstrates nicely why I thought the whole thing was so funny in the first place. Obviously it’s just one excerpt and I’m sure there are serious conversations that take place over there too. But even going by that one example, it’s pretty clear that the list itself and the qualities and qualifications of those on it is a major concern to those on it. It’s like the liberal egghead version of Heathers.

Boy I wish I introduced myself to Jonah at the Boston meeting back in ’04.

Lou Minatti is a nice Italian name so I’m not surprised he talks sense with the new “I’m leaving” crowd:

Give it a rest, people. Leave already, or fight for what you believe in. I can’t stand your whining.

I second the motion. Even at our worst it is the best place to be.
