The Respect for Marriage Act violates four clauses of the First Amendment

On Tuesday the Senate passed the Respect for Marriage Act.  Twelve traitorous Republicans joined with the Democrats to pass this Bill, which will trample on the Religious Liberty of every American, particularly those who believe in traditional marriage. 

Freedom of Religion is one of our most important God-given natural rights.  It is enshrined in the First Amendment.  Thanks to this clause, the federal government is barred from trampling on the religious freedom of every single individual. 

This letter from Republican Senator Mike Lee chronicles just how the Respect for Marriage Act violates the Free Exercise of Religion clause.

As you are aware, we are one step closer to passing into law the Respect for Marriage Act. In the Obergefell oral arguments, there was a now infamous exchange between Justice Alito and then–Solicitor General Donald Verrilli. In response to Justice Alito asking whether, should states be required to recognize same-sex marriages, religious universities opposed to same-sex marriage would lose their tax-exempt status, General Verrilli replied, “ . . . it’s certainly going to be an issue. I don’t deny that. I don’t deny that, Justice Alito, –it is going to be an issue.”

And it is an issue. Obergefell did not make a private right of action for aggrieved individuals to sue those who oppose same-sex marriage. It did not create a mandate for the Department of Justice to sue where it perceived an institution opposed same-sex marriage, but the Respect for Marriage Act will. What we can expect should this bill become law is more litigation against those institutions and individuals trying to live according to their sincerely held religious beliefs and moral convictions.

Should Congress decide to codify Obergefell and protect same-sex marriages, we must do so in a way that also resolves the question posed by Justice Alito. Instead of subjecting churches, religious non-profits, and persons of conscience to undue scrutiny or punishment by the federal government because of their views on marriage, we should make explicitly clear that this legislation does not constitute a national policy endorsing a particular view of marriage that threatens the tax exempt status of faith-based non-profits. As we move forward, let us be sure to keep churches, religious charities, and religious universities out of litigation in the first instance. No American should face legal harassment or retaliation from the federal government for holding sincerely held religious beliefs or moral convictions.

According to this Fox News article, Republicans were able to incorporate a very modest religious liberty amendment, while failing to pass true religious liberty amendments. 

An amendment by Senator Susan Collins, R-Maine, and Tammy Baldwin, D-Wis., was adopted Monday evening aimed at making sure the bill does not undermine religious liberty and states that nonprofit religious organizations “shall not be required to provide services” to a marriage it opposes.

On Tuesday the senate also considered three additional amendments to the bill by Senators Marco Rubio, R-Florida, Mike Lee, R-Utah, and James Lankford, R-Okla., that would have purportedly added stronger religious liberty protections to the measure, but all failed to reach a threshold vote for final adoption. 

The First Amendment consists of the following six clauses. 

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

The Respect for Marriage act violates four of them.  Firstly, this act establishes progressive orthodoxy as the official religion of the United States, in direct violation of the establishment clause.  After this act is passed, Americans who hold and espouse views contradictory to progressive orthodoxy will be punished, violating the free exercise of religion clause and the free speech clause.  The freedom to assemble includes the freedom to not assemble.  The Respect for Marriage Act forces private venues to assemble for marriage ceremonies that violate their religious beliefs.

I never thought I’d live to see freedom become a four-letter word here in the United States

It is beyond common knowledge to those born before 1970 that from the very beginning of the Unites States, freedom was universally cherished.  Sadly most college students would be shocked and greatly distressed to learn that universal truth. They have been subjected to endless progressive indoctrination.

It has become quite evident over the past decade that progressives dislike freedom rather intensely, more intensely than vampires dislike crucifixes and garlic.  Progressivism is a collectivist philosophy derived through a couple of generations from the teachings of Karl Marx. 

Marxists believe that the vast majority of common folk are not capable of deciding for themselves. They believe that the unwashed peasants need the unending guidance of enlightened experts to guide their every move.  Most of the brainwashed victims of progressive indoctrination believe that they will be one of the enlightened experts who will be guiding the unsophisticated masses.

They are in for a very rude awakening.  All collectivist societies descend into a totalitarian nightmare where only a small number of the most ruthless thugs get to make decisions.  The vast majority end up as impoverished slaves.

The lack of organized resistance to the Wuhan Flu lockdowns and mandates is a sure sign of just how widespread and how thorough the progressive indoctrination has been over the past few decades.  Those who called for the freedom to live their lives, free from mandates, have been met with outright hostility.  Mass counter protests have met those protesting for freedom.

It was shocking to see the liberal media’s meltdown over Elon Musk’s attempt to buy Twitter.  Check out this pathetic attack on Elon Musk by the AP.  It shows how poorly the left understands freedom of speech and how much they loath it.

The freedom to defend yourself has been under constant assault from the left.  The Second Amendment has been one of their most ceaseless targets.

Your freedom to move as you wish is now in jeopardy because the Biden regime has decreed that all cars built after 2026 must have a government controlled kill switch.

Biden recently signed into law a requirement that all vehicles produced after 2026 be fitted with a remote kill switch. Electric vehicles are already equipped with this capability via internet-connected “superchargers.” These corporations can sell you a product for tens or even hundreds of thousands of dollars, then prevent you from using them.

Worse yet, if the law is not challenged or repealed, these kill switches will have a “back door” that allows government agencies to shut your vehicle off remotely as well.

The lack of resistance to this egregious threat to one of our most basic freedoms has been depressing in the extreme

The Biden Regime has declared that those who spread the truth online are domestic terrorists

The Biden Regime is too ignorant, obtuse, and corrupt to comprehend that the First Amendment specifically prevents the federal government from infringing on the free speech of anyone in the United States. 

Last week, Biden’s Department of Homeland Security issued a National Terrorism Advisory System Bulletin that tramples on the First Amendment more thoroughly than any law, executive order, proclamation, or edict ever issued by any branch or agency of the federal government.  Here is the opening paragraph of that nauseating pile of refuse.

The United States remains in a heightened threat environment fueled by several factors, including an online environment filled with false or misleading narratives and conspiracy theories, and other forms of mis- dis- and mal-information (MDM) introduced and/or amplified by foreign and domestic threat actors. These threat actors seek to exacerbate societal friction to sow discord and undermine public trust in government institutions to encourage unrest, which could potentially inspire acts of violence. Mass casualty attacks and other acts of targeted violence conducted by lone offenders and small groups acting in furtherance of ideological beliefs and/or personal grievances pose an ongoing threat to the nation. While the conditions underlying the heightened threat landscape have not significantly changed over the last year, the convergence of the following factors has increased the volatility, unpredictability, and complexity of the threat environment: (1) the proliferation of false or misleading narratives, which sow discord or undermine public trust in U.S. government institutions; (2) continued calls for violence directed at U.S. critical infrastructure; soft targets and mass gatherings; faith-based institutions, such as churches, synagogues, and mosques; institutions of higher education; racial and religious minorities; government facilities and personnel, including law enforcement and the military; the media; and perceived ideological opponents; and (3) calls by foreign terrorist organizations for attacks on the United States based on recent events.

This odious pile of excrement is stuffed full of far more disinformation, mistruths, half-truths, and outright lies than anything I’ve ever encountered on social media.  This mound of manure specifically targets those on the political right, who are for the most part peaceful, and ignores the true purveyors of violence, the political left, with their ANTIFA and BLM.

Those of us on the political right are only guilty of disseminating the truth on social media.  The truth we spread conflicts with the nonsense spread by Democrats and their cohorts in the mainstream media, the so called medical experts, and those who run social media.

There is no misinformation exception to the First Amendment.  Thanks to the First Amendment, the federal government can play no role determining what is the truth or disinformation.  Stopping the spread of outright lies is not even something the federal government has the authority to do.

In the Additional Details section of this garbage, Biden’s Homeland Security offers a pack of lies to defend this unconstitutional edict.

The primary terrorism-related threat to the United States continues to stem from lone offenders or small cells of individuals who are motivated by a range of foreign and/or domestic grievances often cultivated through the consumption of certain online content. The convergence of violent extremist ideologies, false or misleading narratives, and conspiracy theories have and will continue to contribute to a heightened threat of violence in the United States.

Wrong, it was BLM and ANTIFA, and the rest of the leftist clowns who were doing all of the rioting, looting, and other violence

Key factors contributing to the current heightened threat environment include: The proliferation of false or misleading narratives, which sow discord or undermine public trust in U.S. government institutions: For example, there is widespread online proliferation of false or misleading narratives regarding unsubstantiated widespread election fraud and COVID-19. Grievances associated with these themes inspired violent extremist attacks during 2021.  Malign foreign powers have and continue to amplify these false or misleading narratives in efforts to damage the United States.

This paragraph declares those of us who spread the truth about the Wuhan Flu, the carnage and suffering caused by mandates and lockdowns, the clot shot, and the theft of the 2020 election from President Trump are domestic terrorists.

Continued calls for violence directed at U.S. critical infrastructure; soft targets and mass gatherings; faith-based institutions, such as churches, synagogues, and mosques; institutions of higher education; racial and religious minorities; government facilities and personnel, including law enforcement and the military; the media; and perceived ideological opponents:

Is there proof that any of this happened? No !!

 Foreign terrorist organizations and domestic threat actors continue to amplify pre-existing false or misleading narratives online to sow discord and undermine public trust in government institutions. Some of these actors do so to encourage unrest, which could lead to acts of violence against the facilities, individuals, institutions, and organizations cited above.

As COVID-19 restrictions continue to decrease nationwide, increased access to commercial and government facilities and the rising number of mass gatherings could provide increased opportunities for individuals looking to commit acts of violence to do so, often with little or no warning.

The Biden Regime is declaring that ending all of these liberty destroying mandates and lockdowns will lead to an upswing of terrorism.   What a joke !!!!

Meanwhile, COVID-19 mitigation measures—particularly COVID-19 vaccine and mask mandates—have been used by domestic violent extremists to justify violence since 2020 and could continue to inspire these extremists to target government, healthcare, and academic institutions that they associate with those measures.

What violence?  There has been no violence, only peaceful protests, and nowhere enough of them.

Domestic violent extremists have also viewed attacks against U.S. critical infrastructure as a means to create chaos and advance ideological goals, and have recently aspired to disrupt U.S. electric and communications critical infrastructure, including by spreading false or misleading narratives about 5G cellular technology.

Even questioning the safety of 5G will get you labeled a domestic terrorist.

Some domestic violent extremists have continued to advocate for violence in response to false or misleading narratives about unsubstantiated election fraud. The months preceding the upcoming 2022 midterm elections could provide additional opportunities for these extremists and other individuals to call for violence directed at democratic institutions, political candidates, party offices, election events, and election workers.

Yup, anyone who posts the truth about Democrats stealing the election from Trump is a domestic terrorist.

A small number of threat actors are attempting to use the evacuation and resettlement of Afghan nationals following the U.S. military withdrawal from Afghanistan last year as a means to exacerbate long-standing grievances and justify attacks against immigrants.

Even joking about Biden’s disastrous Afghanistan withdrawal will get you labeled a domestic terrorist.

The How We Are Responding section contains clear violations of the First Amendment

DHS’s Office of Intelligence and Analysis established a new, dedicated domestic terrorism branch to produce the sound, timely intelligence needed to counter related threats. The Department expanded its evaluation of online activity as part of its efforts to assess and prevent acts of violence, while ensuring the protection of privacy, civil rights, and civil liberties.

The Biden Regime is using the Intelligence Agencies of the United States to spy on the American People.

DHS is working with public and private sector partners, as well as foreign counterparts, to identify and evaluate MDM, including false or misleading narratives and conspiracy theories spread on social media and other online platforms that endorse or could inspire violence.

DHS has officially deputized Facebook, Twitters, and other social media sites.  They will gladly comply just like they gladly complied when the Biden Regime asked them to silence those of us who spread the truth on their platforms.

This egregious violation of the First Amendment calls for mass non-violent protests and mass non-violent civil disobedience.  Oh yeah, issuing this odious proclamation is a High Crime, making it an impeachable offence.  Spineless Republicans however will do nothing about it.

The Biden Regime has officially instituted a Ministry of Truth

Ever since Joe Biden was illegitimately installed in the White House his administration has demonstrated a very remarkable disregard for the Constitution of the United States.  This was on full display last week when Biden’s press secretary announced that the Biden regime has deputized Social Media corporations formally as the official Ministry of Truth for the federal government of the United States.  This is in direct violation of First Amendment.

This New York Post article White House ‘flagging’ posts for Facebook to censor over COVID ‘misinformation’ fully documents the shameful business.

White House press secretary Jen Psaki said Thursday the Biden administration is identifying “problematic” posts for Facebook to censor because they contain “misinformation” about COVID-19.

Psaki disclosed the government’s role in policing social media during her daily press briefing after Surgeon General Vivek Murthy called on companies to purge more pandemic posts.

It absolutely not up to the federal government, or any level of government, to stop the flow of any type of information, whether it be disinformation or not.  Far too often governments label truthful information they do not like or is inconvenient to them as disinformation.

Censorship is a blatant violation of the First Amendment and is also a serious violation of the founding principles of the United States.  During the conference Biden’s press secretary and Surgeon General admitted to the censorship.

“We are in regular touch with the social media platforms and those engagements typically happen through members of our senior staff and also members of our COVID-19 team — given as Dr. Murthy conveyed, this is a big issue, of misinformation, specifically on the pandemic,” Psaki said.

Murthy said “we’re asking [social media companies] to consistently take action against misinformation superspreaders on their platforms.”

This quote by the Surgeon General pings the irony meter,  The only way to ensure individuals can make informed decisions is if they have access to all of the information from all sides of every issue.

“Misinformation takes away our freedom to make informed decisions about our health and the health of our loved ones during the COVID-19 pandemic. Health misinformation has led people to resist wearing masks in high-risk settings. It’s led them to turn down proven treatments and to choose not to get vaccinated. This has led to avoidable illnesses and deaths,” Murthy said.

Those on the political left have been proven wrong over and over again during this pandemic when it comes to science and medicine.  They have been distorting science for decades now to create a climate of fear so they can strip away the freedom and rights of all people.  Their response to the Coronavirus pandemic is the latest installment of this.

Psaki maintains the government has “a responsibility, as a public health matter, to raise that issue” of people allegedly dying en masse because of uncensored Facebook posts that don’t comport with the White House’s vaccine messaging. This isn’t a caricature of the White House’s position either. When a reporter asked President Joe Biden directly last week what his message is to sites like Facebook, Biden replied, serious as a heart attack, “They’re killing people.”

What’s going on here isn’t really an attempt to save Americans from disease. It’s a desperate attempt by the ruling class to save their own rear ends from information that threatens their ideological goals.

Democrats at the helm of the executive and legislative branches aren’t looking to squash so-called misinformation because it’s the only way to keep people from dying (which still wouldn’t justify their authoritarianism, by the way). Biden, Psaki, and their friends in Congress and Silicon Valley are working to snuff out their opponents’ speech because not only do they think it will help them politically, as it likely did in the 2020 election, but because they believe they can get away with it — again, as they did in the 2020 election.

These revelations are deeply concerning.  The blatant actions by your administration to work with big tech companies to censor Americans’ free speech are shocking – and arguably a violation of the First Amendment.  Communist countries such as Cuba are currently taking away their citizens’ right to use the internet to communicate; the U.S. government should be standing up to, not looking to mirror, authoritarian regimes such as these
