This applies to everything from food to religious expression. To progressives, however, a fundamental right means a right to be, affirmatively, provided with something. I wonder how those who think that someone else ought to pay for one’s health care will apply the same logic to sex.
There is a very serious point, and that is worth making but as a long married man all I can think of is the pillow talk: “I know you’ve got a headache but honey it’s a fundamental right!”
Between this and the 9th circuit not only do I have a fundamental right to go out and get some if the wife is not in the mood, but my ability to lie about it when I get home is constitutionally protected.
